The Chief Executive of the Federal Road Safety Corps
(FRSC), Mr Boboye Oyeyemi, maybe jailed if found
guilty of contempt of court following the initiation of
contempt proceedings against him by a lawyer, Tope
Alabi, for allegedly disobeying a court order stopping
the corps from imposing fines on motorists in the
country.

It would be recalled that a Federal High Court
presided over by Justice John Tsoho in Lagos had on
September 26, 2014, nullified FRSC's powers to fine
motorists for violating traffic rules.
According to Alabi, FRSC was not empowered to
impose fines under sections 10 (4) and 28 (2) of the
FRSC (Establishment) Act 2007 because it is not a
court.

Alabi in the committal proceedings initiated against
Oyeyemi is contending that FRSC officials have not
complied with the judgment which he noted was yet
to be set aside by the Court of Appeal.
According to him, FRSC did not apply for nor obtain
any stay of execution of the judgment.
In the form 48 and 49, Notice of consequences of
disobedience to order of court, dated August 20, the
Corps Marshal Oyeyemi is warned of being held
liable for contempt if his men continue to violate the
order by arresting and imposing fines on erring
motorists without taking them to court.
"Take notice that unless you obey the directions
contained in this order, you will be guilty of contempt
of court and will be liable to be committed to prison"
he said in his notice published in Vanguard
newspaper.

According to the court, FRSC can arrest motorists for
traffic offences, but it must take them to mobile or
other courts which have the powers to punish traffic
offenders.
The lawyer further prayed the court should declare
that only a court of competent jurisdiction can
pronounce a person guilty under Section 10 (4) and
28 (2) of the FRSC (Establishment Act) 2007 and
Regulation 143 of the Nigerian Roads Traffic
Regulation, 2011.

The robbery suspects who allegedly robbed banks in Ikorodu have told the Federal High Court in Lagos that the confessional statements they made to the police were not voluntary.

French President Francois Hollande on Monday
bestowed the Legion of Honor, France's highest
decoration, on a Briton and three Americans who
subdued a heavily armed gunman aboard a high-
speed train on Friday.
At a ceremony in Paris, Hollande pinned medals on
the chests of Briton Chris Norman and Americans
Spencer Stone, Alek Skarlatos and Anthony Sadler. He
said their actions last week in the face of terror
provided "a message of courage, solidarity and
hope."
"A terrorist decided to commit an act. He had enough
weapons and ammunition to carry out a real
carnage, and that's what he would have done if you
hadn't tackled him at a risk to your own lives,"
Hollande said.
Hollande said the two Americans who first tackled
the gunman were soldiers, "but on Friday you were
simply passengers. You behaved as soldiers but also
as responsible men."

The fighter pilots of the Nigerian Air Force have
destroyed two trucks believed to be carrying logistic
supply for the BOKO Haram insurgents. The Director,
Public Relations and Information of the Nigerian Air
Force, Air Commodore Dele Alonge, said in a
statement on Sunday night that the trucks which were
covered and parked in different locations were
destroyed by the NAF Agusta helicopter on armed
reconnaissance mission at Belel, along the nation's
border with Cameroon. He said, "Two trailers
suspected to be carrying logistics support to
members of the Boko Haram terrorists' sect have
been intercepted and destroyed by the Nigerian Air
Force Agusta helicopter on armed reconnaissance
mission around the Nigeria-Cameroon border. "The
trailers were covered and parked at different
locations in the bush around the border town of
Belel." Alonge said the recent intensified aerial
campaign, designed to provide support to the ground
troops led by the Chief of Army Staff, Lt. Gen Tukur
Buratai, was coordinated by the Chief of Air Staff, Air
Chief Marshal Sadique Abubakar. "The recent air
operation against the insurgents was
commanded by the Chief of the Air Staff, Air Marshal
Sadique Abubakar, from NAF reconnaissance
aircraft, the King Air 350i. "The CAS coordinated the
various NAF platforms involved in the operation to
provide close air support to ground forces, led by the
Chief of the Army Staff, Lt Gen Tukur Buratai, as they

Force Spokesman said that a NAF attack helicopter,
which was hit during the operation was flown to base

Rivers PDP, APC clash at INEC office
THE Rivers State chapters of the Peoples Democratic
Party and the All Progressives Congress have
disagreed over an alleged power outage at the office
of the Independent National Electoral Commission.
The state APC had blamed the alleged inability of
INEC to provide constant power supply to speed up
the process of providing certified true copies of the
2015 election materials on sabotage.
An APC agent in the state, Mr. Michael Igoli, who was
at the INEC office on Friday to monitor the exercise,
specifically attributed the breakdown of the
generator used by INEC to sabotage.
It will be recalled that the Port Harcourt Electricity
Distribution Company had disconnected electricity
supply to the INEC office, located on Port Harcourt-
Aba road.
But Igoli explained that though INEC provided an
alternative power supply when it became obvious
that PHED would not supply it power, the generator
was salted, a development that led to the breakdown
of the generator.
Igoli, who spoke with The PUNCH at the INEC
premises, added that the development had also
delayed the process of delivering the CTCs to the
tribunal.
He said, "We have had great challenges with power.
Deliberately and curiously, power is the biggest
challenge in INEC office in Rivers State.
"There are issues of PHED bills not being paid, the
PHED line disconnected and the generators of the
commission here have broken down. The one that
was hired eventually was salted. Of course, that is
clear sabotage.
"But so far, so good, you can see that the work is on.
This is what we expected right from when we applied
for certified true copies of all the documents used in
the elections.
"Unfortunately, we did not get them until INEC at the
national level intervened by setting up a task force
that kept the process driven and that caused a whole
lot of delay in the delivery of these materials."
On the other hand, the Deputy Publicity Secretary of
the PDP, Mr. Samuel Nwanosike, described the claim
by the APC as funny and strange, adding that INEC's
generators have been working since the exercise
began.
Nwanosike explained that though he learnt that one
of the generators developed a fault, he was told that
measures were being put in place to fix it.
He maintained that there was nothing like sabotage
or salting of a generator, maintaining that the
allegation was one of the APC's propaganda to gain
public sympathy.
Nwanosike said, "The allegation is funny and strange.
I have been here since morning and I have never
even heard such a story that the generator at INEC's
office here was salted.
"It is a big lie from the APC. As I speak to you, INEC is
discussing how to go and service their generator.
One of the generators has been bad for two months.
The other one has been working.
"As soon as the committee arrived on Wednesday, it
was Thursday when they (committee on certification
of election materials) wanted to start work that the
generator went bad. There is nothing like sabotage by
anybody.
"It is the issue of PHED light. The APC men are also
aware that they (INEC) have been having problems
with the PHED over the payment of bills. They owe
PHED and this issue has been there for over six
months.
"It is shocking to hear them come and lie and turn
around to see how they can curry cheap favour
through propaganda."
When contacted to speak on the matter, the state
INEC Public Relations Officer, Anthonia Nwobi, told
The PUNCH that contrary to the claim, the generators
were working.

HOW OBASANJO ORDERED NNPC TO RETAIN NLNG
DIVIDENDS TO FUND NEW TRAINS
• Concerns mount over sharing of $7.3bn in dividend
account
Following the controversy surrounding the retention
of dividends paid by the Nigeria Liquefied Natural
Gas (NLNG) Company Limited to the Nigerian
National Petroleum Corporation (NNPC), it has
emerged that the initial directive to retain its 49 per
cent share of dividends was actually given by former
President Olusegun Obasanjo when he was in office.
Arising from this is another brewing controversy as
to whether the dividends belong to the Federation
Account for sharing amongst the three tiers of
government, or just to the federal government, in
this case the NNPC.
The previous management of NNPC when Obasanjo
was in office had argued successfully that while the
taxation revenues of NLNG belong to the Federation
Account, the dividends belong to NNPC, which
needed the dividend payments to reinvest in the new
trains of NLNG.
It was on this basis that Obasanjo ruled in their
favour and the Jackson Gaius-Obaseki-led NNPC then
ring fenced the dividends in a special (investment)
account and used it to successfully reinvest in NLNG
Trains 3 to 6 without recourse to the federal
government, according to officials familiar with the
transaction.
But with the state governors seeking more revenues,
they are today insisting that they were short changed
by the Goodluck Jonathan administration in not
paying the dividends to the Federation Account for
sharing amongst all tiers of government.
In reinforcing the narrative of state governors, the
Nigerian Extractive Industries Transparency Initiative
(NEITI) also recently disclosed that NNPC had failed
to remit $11.6 billion to the Federation Account,
which was paid by NLNG and called on President
Muhammadu Buhari to recover the amount.
NLNG was set up as a joint venture company
comprising NNPC with 49 per cent equity, Shell,
which serves as its operator - 25.6 per cent, Total
LNG Nigeria Limited - 15 per cent and Eni - 10.4 per
cent, as its shareholders.
However, it is not clear if NNPC's equity in NLNG was
paid for by the "federation" or the "federal
government" as this was done during the military
regime of the late General Sani Abacha when it was
basically a command unitary government.
A Final Investment Decision (FID) was taken on NLNG
by its shareholders in November 1995, while the
construction of the gas transmission system, and
second and first trains were completed in September
1998, August 1999 and February 2000 respectively.
Since then, it has built four more trains between
November 2002 and December 2007 to bring the
total number of trains to six.
The base project (Trains 1 and 2) which cost $3.6
billion, was financed by NLNG's shareholders. The
third train (expansion project), including additional
storage, cost $1.8 billion and was funded by
shareholders as well as reinvested revenue from the
base project.
The NLNG Plus project (Trains 4 and 5) cost $2.2
billion and was funded with a combination of
internally generated revenue and third party loans
amounting to $1.06 billion.
Train 6 (NLNG Six project) cost $1.748 billion and
financing was handled by shareholders, bringing the
total cost of building six LNG trains to $9.348 billion.
The FID for Train 7, however, has still not been taken
despite efforts by NLNG to get the federal
government to give NNPC the green light for the next
train.
But THISDAY checks revealed that NNPC currently
has some $7.3 billion dollars in the investment
account with which it intends to fund its share of
NLNG Train 7, Brass LNG (in which over $1 billion has
already been invested) and OK LNG, which is still
troubled by economic and investment hurdles.
But governors at the last National Economic Council
(NEC) meeting determined that the dividends belong
to the Federation Account and must be shared
amongst all tiers of government.
It is not clear what the final decision of Buhari will be
but oil industry experts and NNPC officials have
cautioned that should the funds be shared and spent,
there will have no funds to reinvest in gas at a time
when the future of oil revenues is uncertain and oil
prices are at an all time low.
Providing insight on Obasanjo's directive, a retired
senior executive of NNPC confirmed that the
corporation was asked to retain the dividends paid by
NLNG in order to meet its share of investment after
FIDs had been taken to build subsequent trains of
NLNG.
"As you are aware, from the Abacha days, Nigeria
was already having problems funding its share of
cash calls for the joint venture oil contracts with the
oil majors.
"So in order to avoid a situation whereby NLNG's
expansion was impeded by the same problem,
Obasanjo directed that we retain the dividends paid
by the company for its expansion programme," he
said.
He added that the former president's directive was
implemented to the letter because it was in the
interest of Nigeria to continue to harness its gas
resources, as gas is the future, and today it is saving
the country in the depressed crude oil environment.
"Besides, Nigeria is more of a gas producer than an
oil producer, so we deemed the directive as a life
saver for NLNG and Nigeria's future," he explained.
Officials of NNPC also confirmed THISDAY's
investigations that the corporation currently has
about $7.3 billion from NLNG dividends but the
money has been kept aside for investment in NLNG
Train 7, Brass and OK LNG.
Another official also expressed concern that at the
last NEC meeting, the governors had insisted that all
funds from NLNG should be paid into the Federation
Account, adding: "If we do not reach a compromise
with the governors, when we have to fund our share
of Train 7 and other LNG projects, we will encounter
the same difficulties we encountered with the JV cash
calls, but we believe the issues will be resolved as
NNPC becomes more transparent with its operations
and opens its books to scrutiny."
Given its pioneer status in 1999 when it commenced
production, NLNG was granted a tax holiday for
several years by the federal government and did not
start to pay taxes until 2014.
According to the information on its website, in 2014,
it paid N220 billion (about $1.375 billion using N160/$
as exchange rate) to the Federal Inland Revenue
Service (FIRS) while its second tax payment of $1.6
billion was in June this year and shared by the three
tiers of government in July. It was this payment in
July that opened the eyes of state governors to
NLNG's revenue and are thus seeking more than the
tax revenue from the company.
NLNG tax payments so far make it the highest
taxpayer in Nigeria and sub-Saharan Africa.
In terms of dividends to its shareholders, the
company has paid $30 billion between 2004 and
2014, putting NNPC's share of dividends at $14.9
billion to date.

APC commends Service Chiefs for personally leading
war against insurgency
The All Progressives Congress (APC) has commended
the Service Chiefs for showing leadership by example
by personally taking charge of the ongoing stepped-
up fight against Boko Haram, calling the development
a breath of fresh air in the counter-insurgency battle.
In a statement issued in Abuja on Monday by its
National Publicity Secretary, Alhaji Lai Mohammed,
the party said the widely published report that the
Chief of Army Staff (COAS), Lt.-Gen. Tukur Buratai,
and the Chief of Air Staff (CAS), Air Marshal Sadique
Abubakar, are personally coordinating the efforts of
their troops in the theatre of war is the best news to
have emerged from the frontline of the Boko Haram
battle.
''There can be no bigger boost to the morale of the
gallant troops who are combating Boko Haram than
the sight of their Service Chiefs personally leading the
charge from one village to another battling the
insurgents or flying in a reconnaissance aircraft

Meanwhile, the party has also commended the State
Governors, mostly in the North-west, who have
decided to work together to address the security
challenges in the area, especially the worsening
cases of cattle rustling that cuts right into the artery
of the economic well being of the people of the
region.
It said the efforts, which have led to the recovery of
over 3,000 cows and the arrests of some bandits by
the joint security task force set up by the states, must
continue unhindered.
''Cattle rustling and the other security challenges in
the North-west in particular are all inter-linked and
must be addressed holistically.
This is why we are delighted that the Governors of
states within and outside the North-West - Kaduna,
Zamfara, Katsina, Kebbi, Niger, Kano and Sokoto -
have decided to pool their resources to ensure that
there is no hideout for criminals or terrorists,'' APC

Air Force chief coordinates fight against Boko Haram
Two trailers suspected to be carrying logistics
support to members of the Boko Haram Terrorist
(BHT) sect have been intercepted and destroyed by
the Nigerian Air Force Agusta helicopter on armed
reconnaissance mission around the Nigeria-Cameroo
n border. The trailers were covered and parked at
different locations in the bush around the border
town of Belel. The recent air operation against the
BHTs was commanded by the Chief of the Air Staff
(CAS), Air Marshal Sadique Abubakar from NAF
reconnaissance aircraft, the King Air 350i. The CAS
coordinated the various NAF platforms involved in
the operation to provide close air support to ground
forces, led by the Chief of the Army Staff, Lt Gen
Tukur Buratai, as they advance from Dikwa to
Gamboru Ngala. Meanwhile, NAF 260, a Mi-24V
attack helicopter was hit during the operation. One of
the main rotor blades was hit and damaged however
the pilot was able to successfully fly the helicopter
back to base to land. The affected aircraft has since
been repaired and is back to the theater of operation.

We have reduced Boko Haram to wanderers, says ex-
Army Commander
The former Commander, Army Corps of Engineers,
Major General Sarduarna Davies has said that the
Nigerian Army (NA) has reduced the terrorist group,
Boko Haram to wanderers and bandits.
Davis stated this on Friday at the corps headquarters
in Bonny Camp, Lagos, while handing over to his
successor, Major General Edmund Obi.
The ex-corps Commander reminded his personnel
that the ongoing war against the terrorists was an
engineering and logistics war, and urged them to
ensure that only trained personnel are deployed to
the area.
"I am very certain that we are winning the war in the
northeast. I am just in from there and I can tell you
that they are just bunch of marauders who are just
acting like bandits now.
"They don't act as a formidable force, we can't say
this is where they are, they are just roving around
and I know that the Chief of Army staff is putting
troops in place to comb the whole of northeast and
push them to a place where they can be annihilated.
"I've been in and out of that place as many times as I
can so I exactly know what I am talking about."
Although Sarduarna confirmed that the NA was
suffering from dearth of equipments, he however
stated that the army headquarters was on top of the
situation and would soon deliver the necessary tools
to conclude the war.
Also speaking at the occasion, the incumbent
Commander the corps assured that the army was
doing everything within its power to uncover and
destroy the source of IEDs for the terrorists.

Usain Bolt upset the form book to defend his World
Championship 100m title with a dramatic win over
hot favourite Justin Gatlin in the final at the Bird
Nest's Stadium in Beijing.
Jamaica's world record holder ended Gatlin's
unbeaten run that had stretched over 28 races with a
winning time of 9.79seconds - a season's best for a
man who had been plagued by injury and lack of
consistency entering Beijing.
American's Trayvon Bromell claimed bronze with a
time of 9.92 seconds. Gatlin was a 2/5 favourite for
the title with Bolt drifting to 9/4 after the semi-finals,
but the Olympic champion used all his reserves of
power and strength to hunt down Gatlin despite
getting off to a slower start in the final.
He admitted he had toiled to get the proper spring
from the starting blocks, but his natural sprinting
talent saw him through. Bolt will be a popular winner

Parradang's Suspension: Crisis Averted At
Immigration Headquarters
What would have degenerated into full blown
breakdown of law and order was yesterday averted at
the national headquarters of the Nigeria Immigration
Service (NIS), when some Pro-Parradang boys
allegedly went on rampage over President
Muhammadu Buhari's suspension of their 'son' and
boss, Mr. David Parradang, who they fear, might not
be recalled.
LEADERSHIP SUNDAY gathered that the development
created tension around Sauka community, almost
paralysing business activities at the service's popular
Mammy Market.
A source who spoke on the condition of anonymity,
and a trader in the mini market, said, "we were just
here trying to tidy up our sales as it was running late,
when we heard a group of angry officers spitting fire
and alleging partiality in the suspension of the North-
central born Comptroller General of Immigration,
stressing that the development was designed to pave
the way for the mantle of leadership to rest on a
government preferred shoulder."
Trouble was said to have started when another
group, comprising mostly of officers from the South-
east and South-south region of the country, laughed
them to scorn, challenging them to embark on an
open protest to register their grievances, rather than
hide in the popular market to make empty threats.
The southern group, LEADERSHIP Sunday gathered,
repeatedly advised the ranting officers to swallow
what they termed "national disgrace of a demi-god in
shame," and emulate the maturity they displayed
when the axe of suspension first fell on their
'daughter' and former Comptroller General,
Rosemary Uzoma. It was also gathered that feeling
insulted, the northern group promised to make life
unbearable for the latter group, for daring to openly
challenge and ridicule them.
LEADERSHIP SUNDAY further gathered that it took the
intervention of men of the Special Task Force (STF)
and some highly placed officers who were quickly
intimated about the development, to restore law and
order at the service's headquarters, with threats to
submit the names of members of the feuding groups
to the board as well as the Ministry of Interior for
disciplinary action.
Investigations further revealed that a large section of
officers and personnel of the NIS could not hide their
feelings and went into wild jubilation, immediately
the suspension of Parradang, was announced.
When LEADERSHIP Sunday visited the NIS
headquarters yesterday morning to ascertain the
reality on ground, officers were seen in groups at the
main gate cracking jokes, laughing at the top of their
voices and shaking hands in support of the
development.
It was learnt that another group converged in one of
the conference rooms, chanting "Ma su gudu, su
gudu" in Hausa, meaning "Those who want to run
should run," if they are not comfortable with the
development.
An officer, who craved anonymity, told our
correspondent that, "Parradang claimed to have
rebranded our service and bettered staff welfare by
50 per cent. Unfortunately, both claims remain
spurious. No one has really seen where those reflect
and there is no substantial evidence that he actually
reduced poverty by anything above 50 per cent."
According to the officer, Parradang pledged zero
tolerance for corruption and promised that the
officers working at the borders would be
technologically mobilised for better performance,
"but the announcement soon turned out to be an
April fool's joke."
He added that the suspended NIS boss had shown
quite an unbeatable tolerance for corruption, which
was the second biggest challenge of his
administration, after the passport scam, emphasising
that, "not a single indicted passport officer had been
successfully prosecuted since he came on board.
"Under the watchful eyes of Parradang, some officers
linked to the dreaded Boko Haram group are still on
the Immigration payroll, thereby denting our hard
earned integrity."
LEADERSHIP Sunday recalls that President
Muhammadu Buhari on Friday announced the
immediate suspension of the comptroller-general of
Nigeria Immigration Service (NIS), Mr David Shikfu
Parradang, from office.
The suspension was contained in an earlier
statement dated August 21, 2015, and signed by the
director of press, Ministry of Interior, Yusuf Ishiaka
Alhaji, on behalf of the permanent secretary of the
ministry.
According to the statement, the most senior officer of
the NIS, deputy comptroller-general of Immigration,
Martin Kure Abeshi, was directed to take over the
affairs of the office.
However, another statement also dated August 21,
2015, and signed by a director/secretary in the
ministry in charge of Civil Defence, Fire, Immigration
and Prisons Services Board, Mr A.A. Ibrahim,
specifically gave official explanations on why the
immigration boss was suspended.
Parradang's major 'sins', according to the ministry's
statement, were that he issued letters of appointment
of 700 assistant inspectors of Immigration and 900
Immigration Assistants lll into the service without
approval.
The embattled immigration boss was also accused of
refusing to take necessary measures to correct the
alleged wrongdoing, despite repeated advice given to
him by the ministry, which was said to have been
conveyed to him through several letters with
reference nos FMI/PSO/OOl/lll/402 of June 11, 2015,
and FMI/PSO/OOl/lll/411 of June 14, 2015.
Among other reasons for Parradang's removal, was
the controversy surrounding the possession of a
valid Nigerian Visa by an Islamic State of Iraq and
Syria (ISIS) leader, Imam Ahmed Al-Assir, in Lebanon.

Army Reinstates 2,500 soldiers & 102 officers Sacked
Because of Boko Haram
The Nigerian Army has recalled over 2,500 soldiers
who were asked to withdraw from service for alleged
offences committed under the counter-insurgency
operations code named Operation Zaman Lafiya.
The panel set up by the Army, which began sitting in
Kaduna on August 17, has also screened and
reinstated 102 officers, who were sentenced or facing
prosecution in relation to the operations in the
North-East.
Already, the reinstated soldiers and senior officers, it
was learnt, had commenced retraining at the
Nigerian Army Training Centre, Kontangora, Niger
State.
The 2,500 soldiers were among the over 4,000 who
responded to a memo from the Army authorities
inviting soldiers for a review of recent disciplinary
cases, which emanated from the counter terrorism
operations.
The NA had said on August 1, 2015 that the service
would constitute a panel to review all recent
disciplinary cases in the service.
But the Acting Director, Army Public Relations, Col.
Sani Usman, cautioned that the directive to review
disciplinary cases should not be mistaken for a "total
reinstatement of dismissed and deserter soldiers."
Source learnt that more dismissed personnel of the
Army might be brought back to the service as the
screening panel would continue with the review of
cases on Monday (today).
A source in the Nigerian Army, who confided, said,
"The panel has cleared 2,500 soldiers who were
dismissed from their units for minor offences alleged
to have been committed under Operation Zaman
Lafiya.
"The review panel also cleared 102 officers who were
either asked to withdraw, dismissed or facing
prosecution for various offences under the
operation."
Sani Usman said, "This is an ongoing exercise; they
want to ensure that justice is done. I cannot give you
any figure, the authorities are waiting for the
committee's report; they will conclude sitting very
soon."

PDP Forced Me To Sign Fake Results – Abia North

Contrary to accusations that he absconded and
abandoned his duty post during the last general
elections, the Returning Officer, (RO) for Abia North
Senatorial district, Dr. Ihekweaba Chukwugoziem
says he merely refused to sign a fake result allegedly
presented to him by the Peoples Democratic Party,
PDP.
Ihekweaba made the statement before the National
Assembly Tribunal, where he testified as a witness in
the petition filed by the candidate of the All
Progressives Grand Alliance, APGA, Chief David Ogba
Onuoha-Bourdex against Senator Mao Ohuabunwa
of the PDP.
He explained that rather than abdicating his duties,
he stoutly refused to declare the result of the election
based on the falsified data presented to him, adding,
"we started to examine the results local government
by local government, and after we examined
Arochukwu and Ohafia results and discovered huge
anomalies, the Respondents refused and resisted the
continuation of the examination of the remaining
three local government areas.
"Pressure was brought on me to sign and declare the
results as presented with all the manipulations in
them, and I refused, insisting that the right thing
should be done by concluding the examination of the
rest of the local government areas before the
declaration."
The RO stated that he quickly wrote a report, which
he submitted to the REC (Resident Electoral Officer)
informing her that the persuasion on him to
announce a pre-arranged result, which was not in
tandem with the law, did not go down well with him
and his conscience.
When asked under cross-examination why he went to
the Federal High Court to swear to an affidavit after
submitting the report to the REC, he said he decided
to go the extra mile to ensure the right thing was
done based on the report he submitted to his
employers, the Independent National Electoral
Commission, (INEC) on the large scale defalcations,
mutilations and inflation of votes on the result sheets
skewed in favor of the PDP candidate Mao
Ohuabunwa.
Ihekweaba, who is also an Associate Professor in
Computer Engineering at the Michael Okpara
University of Agriculture, Umudike, Abia State,
further alleged that when pressure was mounted on
him by supporters of the Peoples Democratic Party,
(PDP) and its candidate, Senator Mao Ohuabunwa, he
refused to surrender, adding that at no point did
INEC send another person to replace him as the RO.
Under further cross-examination by both the counsel
of the defendant and INEC, the RO remarked that he
was not in a place to know whether INEC had power
to appoint another Returning Officer or not, stressing
that he was appointment via a letter signed by the
Head of Department of Electoral Operations, INEC,
Mr. G. I. Okoli, which he tendered to the tribunal.
The RO added that it was in response to his report
that the REC set up the committee to investigate the
widespread irregularities regretting that while the
committee of which he was a member set about the
assignment, it could not finish its work because after
cross-checking two out of the five local government
areas that make up Abia North Senatorial District
namely Arochukwu and Ohafia, "massive
irregularities were noticed and at that point the
Respondents refused and resisted the continuation of
the examination of the remaining three local
government areas".
When the INEC counsel, Dr. Livy Uzukwu, (SAN)
accused him of absconding, the RO declared:"I did
not abscond, I refused to act against my conscience
by announcing fictitious results in favor of the PDP
candidate who did not win the election.
"Pressure was brought on me to sign and declare the
results as presented with all the manipulations in
them and I refused insisting that the right thing be
done by concluding the examination of the rest of the
local government areas before declaration. The
result I was being pressured to sign did not emanate
from me as the duly appointed Returning Officer for
the Senatorial election."
While denying suggestions by the defense counsel
that he published his report on a national daily and
that he was working for the petitioners, Dr.
Ihekweaba stated that he knew nothing about the
publication, adding that he was not working for
anyone and that he had nothing to lose by doing that
which was needful, by swearing to the affidavit to
ensure that the right things were done.
He asserted that he was answerable to his
conscience and INEC that appointed him, pointing
out that if he needed money, the PDP and the
respondents were ready to pay him more than
anyone could have.
Earlier an expert witness, Mr. Adeola Layiwola, told
the tribunal that analyses of the result sheets
exposed a lot of mutilations pointing out that certain
figures were randomly inserted without cognizance
of their relationship in the context.
The statistician added that a proper computation of
the genuine votes tally showed that the petitioner
Chief Dr. David Ogba Onuoha-Bourdex scored the
highest number of valid votes in the election.
Speaking to reporters shortly after the sitting,
counsel to the petitioner, Chief Chris Uche, (SAN)
said: "I feel happy with what happened in today's
sitting. This crucial witness that testified, the
returning officer for the election had to say the truth;
that he wrote a report and swore to an affidavit of
facts saying that the result that was brought to him to
declare was not the correct result. That is
commendable."
The Senior Advocate noted that for somebody in that
position to risk it and insist on the proper thing being
done "I am very happy and hope that many Nigerians
will adopt this path of honour."
"We have seen the result and like he said, there were
so many discrepancies and irregularities and that the
committee reviewed two local governments out of
five and found a lot of irregularities, they were
bringing pressure on him to still declare the wrong
result and he refused. So he has given that evidence
before the tribunal and with the evidence filed, the
tribunal would come to a proper decision," Chief
Uche remarked.
The legal luminary explained that it was because the
RO refused to declare the wrong result, that made
INEC to go and fish for somebody else to come and
sign the form EC8 and declare the result, pointing out
that what the defense counsel were trying
unsuccessfully to do was to accuse the returning
officer of absconding from his duty post in a bid to
justify the stranger that was procured to announce
the result.
